PACKAGE TOUR AND DAY TRIP CONTRACT
SIDES :
The parties to this agreement are Hatip Pirimi Mah. Esgül Apt. on Yeni Datça road. Tülübaldır Taş, located at No:79/6 – Marmaris / Muğla, with the website www.bctravelmarmaris.com. Type. Tic Cons. Singing. Imp. expulsion Ltd. Ltd. (hereinafter referred to as BC Travel) and the consumer whose name, surname and address are specified in the tour registration form.
SUBJECT :
It covers the mutual rights and obligations of the parties regarding the sale and execution of package tours or day trip tours purchased by the consumer from BC Travel.
PAYMENT OF THE FEE:
The full fee must be paid at the time of registration. If the fee is not paid at the time of registration, the consumer cannot make any claims.
TOUR CONTENT:
1-) All services included in the price are stated in detail in the promotional brochures and promotions of the day trip tour or package tour, and tours and services other than these are subject to an extra fee. In particular, the purchased service; Extra food, beverages, personal expenses, transportation, and all non-program goods and services that the consumer will purchase outside the scope of the Package Tour or day trip tour are not included in the tour price. Visa and passport procedures and service fees, museum-ruins entrance fees are not included in the tour price unless it is specifically stated in the promotions, announcements and brochures that they belong to BC Travel.
2-) BC Travel may change the daily tour or package tour program and its content, provided that it adheres to the specified standards and notifies the consumer in advance.
3-) Plane, ferry, train, bus etc. The departure times of transportation vehicles are valid on the date of the contract. Koral Turizm is not responsible in any way for any later tariff changes made by the carrier companies, or for any disruptions, delays or delays that may occur in the tour program due to the delay in the departure time of the transportation vehicle. For this reason, the consumer will apply to the carrier for any damage that may occur.
4-) Plane, ferry, train, bus etc. in the contract. The departure location, time and number of trips of transportation vehicles should be checked before the trip. Changes may be made for any reason, depending on the means of transportation or for reasons other than those. Although BC Travel informs the consumer about the tour departure details, the consumer is also obliged to learn these details. If the consumer is delayed in using the means of transportation within the scope of the tour for any reason that is not caused by him/her or BC Travel’s failure to fulfill its obligations, BC Travel has no responsibility / refund obligation due to the failure / delay in participating in the tour. In this case, the consumer pays the transportation fee required to participate in the tour.
CANCELLATION-WAIVER AND CHANGE IN THE TOUR:
1-) The package tour or day trip tour, which is announced and planned by BC Travel, can only be organized if sufficient participants are provided. Although BC Travel has taken all necessary care, it prevents the start of the day trip tour or package tour; The daily tour or package tour may be canceled or postponed due to insufficient number of participants, adverse weather conditions, road obstacles, strikes, terrorism, fog, possibility of war, unforeseen technical issues and all force majeure reasons or any other reason not caused by the Consumer. In this case, BC Travel cannot be held responsible for damages arising from cancellation of the contract, or from non-performance or non-performance. However, it refunds the amount received from the consumer within 10 days at the latest without interruption.
2-) The consumer may terminate the contract unilaterally by notifying BC Travel in writing of the termination request.
-For termination notifications made at least 7 days before the start of the package tour (accommodation trip); The amount paid by the participant is his/her own without any deduction, excluding the costs arising from taxes, duties and similar legal obligations that must be paid, compulsory travel health insurance, visa fees, payments made related to the package tour and cannot be refunded (such as transportation, accommodation fees). is refunded. Since the tickets are purchased as group tickets for trips made by plane, train, ship and land vehicle, the cancellation and change rules of the relevant companies apply exactly.
-In case of termination notifications made less than 48 hours before the start of the package tour or day trip tour, the consumer accepts and undertakes to pay the entire tour fee as withdrawal compensation. Date changes made by the consumer have the effect of termination/cancellation.
3-) The consumer may transfer the right to participate in the package tour or day trip tour to a third party, provided that the package tour or day trip tour fee is paid and BC Travel is notified in writing at least 7 days before the departure date. In this case, the person transferring the package tour or day trip tour and the person transferring it are jointly responsible for paying all additional expenses arising from the transfer in question.
4-) If the consumer misses the start of the day trip tour or package tour, unless BC Travel is notified in writing within 1 hour after the departure time that the consumer will participate in the tour, all reservations made on behalf of the consumer will be cancelled. In this case, no refund will be made to the consumer.
5-) BC Travel’s package tour (a contract that is sold or promised to sell at an all-inclusive price, with at least two of the transportation, accommodation and other touristic services that are not considered auxiliary to them, and the service covers a period of more than twenty-four hours or includes overnight accommodation) Marmaris Gülsoy Insurance Brokerage Service, which is regulated in accordance with the Travel Agencies Law No. 1618. Ltd. It is under the guarantee of the Company’s PACKET TUR TRAVEL INSURANCE POLICY. This travel insurance covers ‘failure to fulfill the commitment’, ‘failure to provide the service as promised’ and ‘return guarantee’ under the conditions specified in the policy, limited to the package tour cost. Insurance scope and conditions are stated in detail in the policy. BC Travel has no liability regarding the content, scope and application methods of the guarantees.
GENERAL PROVISIONS
1-) The consumer acknowledges that he/she is responsible for all kinds of baggage and its contents, that he/she is obliged to comply with the laws and practices governing the vehicle he/she will travel in and the facility he/she will stay in, and that he/she is obliged to follow and control the belongings he/she has with him/her, and that he/she is responsible for the purchase by the guide, facility, agency and transportation vehicle authorities. It will comply with the rules declared regarding the service received, it will not endanger the life and property safety of third parties, otherwise BC Travel will not perform the service subject to the contract and therefore it has no right to return, it will not be responsible for any lost, theft or lost items during transportation, accommodation and tour. BC Travel accepts, declares and undertakes that neither its employees nor its employees have any legal and/or criminal liability. Money, valuable documents and similar valuable jewelry should not be kept in the luggage. BC Travel is not held responsible for valuable items in lost luggage.
2-) Visa and passport procedures are the responsibility of the consumer. Since visa procedures are entirely at the discretion of the consulates, BC Travel does not have any responsibility for failure to obtain a visa. Since obtaining a visa does not guarantee entry to that country, BC Travel has no responsibility for those who are not accepted into the country, and therefore does not pay any refund or compensation.
3-) Consumers who do not have a signature on the contract but participate in the trip subject to the contract are deemed to have accepted the provisions of the contract when the consumers they have assigned to register on their behalf sign this contract.
4-) TÜRSAB Arbitration Board is authorized for disputes arising from the contract.
5-) The consumer is responsible for the accuracy of the names declared in the contract. THIS PACKAGE TOUR AND DAY TRIP CONTRACT, drawn up between the Parties, HAS BEEN READ, SIGNED AND ACCEPTED WITH NEGOTIATION AND CONTROL.
